Abstract:

The introduction of forensic short tandem repeat (STR) DNA analysis in the late 1990’s has revolutionized the analysis of evidence from sexual assault cases. STR analysis combines the discrimination power of the previous DNA technology known as RFLP but with the added advantage of being incredibly sensitive. One aspect of this presentation will focus on the types of probative sexual assault evidence that has been successfully analyzed using STR’s. The impact of the Combined DNA Index System (CODIS) database on sexual assault investigation will also be discussed.

The vast majority of jurisdictions in the United States have embraced the presentation of DNA profiling evidence to juries deciding the fate of defendants accused of violent and other crimes. The focus of courts and attorneys confronted with DNA typing evidence has shifted to the presentation of that evidence and effective means to lend meaning to DNA testing results. This presentation will also address issues unique to the actual submission of DNA typing evidence to courts and juries, as well as uses of DNA testing in both criminal profile databasing and post- conviction exonerations.
