Civil Litigation – Legal Options for Survivors

Abstract:
      
     A survivor's emotional damages, injuries, and financial loss must be addressed by the courts, both criminal and civil. Yet, few attacks are civilly prosecuted. This workshop will dispel the myths surrounding civil prosecution that are standing in the way of a survivor considering legal recourse, including:
  • If the District Attorney chooses not to file charges, that's it
  • Can only get money to pay bills
  • The civil attorney will get in the way
  • The civil attorney will compromise the criminal investigation and possible prosecution
  • The civil attorney can always do it later
  • Civil cases are just as hard to win as criminal cases
  • The survivor will have no privacy or confidentiality
  • The survivor said she does not want to go to trial, so that's it
  • Criminal prosecution is all that matters
  • Can’t pursue a perpetrator who doesn't have millions, and there is no one else responsible
  • So what if the landlord knew about the attacks
  • You can't prosecute an employer for failure to act
  • You can't hold the parents responsible

We will also take a look at the various privileges that apply regarding communications between the survivor and Sexual Assault Response Team members. At the conclusion of the workshop, you will have an understanding of all possible legal options for sexual assault survivors.
